Mediators and confidentiality
Mediators do not appear in court to give evidence.
All communications are confidential except as required or permitted by law.
Per statute 44.405

If a mediator is subpoenaed they will charge the sum of $250 per hour for their time, and any legal fees they may incur from the date of service.
By issuing any subpoena you acknowledge you will have to pay for their time spent traveling, preparing and in Court.

The parties in any mediation agree to hold the mediator harmless and will not involve the mediator in any litigation.
Should a party seek redress in the Courts against a mediator, they will accept responsibility for the mediatorís fees to time expended and legal costs.

The maximum amount that can be claimedagainst mediator will be the amount paid for mediation, with no consequential liability.
